USER AGREEMENT
This document is an electronic record under the Information Technology Act, 2000, and the rules and amendments made thereunder. It does not require any physical, electronic, or digital signature.
This agreement forms a legally binding contract between You (referred to as "User") and CatchyDigits.in (referred to as “CatchyDigits,” "We," "Us," or "Our"). By accessing or using the website www.catchydigits.in (referred to as “Website”), you accept the terms outlined here. If you do not agree to these terms, please discontinue your use of the Website.
This document is published in compliance with Rule 3(i) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
1. GENERAL TERMS
1.1. By accessing or browsing the Website, you agree to this User Agreement and all related policies. If you disagree with any terms, discontinue using the Website.
1.2. CatchyDigits reserves the right to modify these terms at any time. Changes will be posted on the Website, and your continued use signifies acceptance of the latest terms.
1.3. Use of the Website indicates your acceptance of this agreement and our Privacy Policy available on the homepage of www.catchydigits.in.
1.4. CatchyDigits delivers products and services only to locations in India. Orders for locations outside India will not be processed.
2. ABOUT US
2.1. CatchyDigits.in operates as an online marketplace and reseller, offering recharge services, mobile connections, and premium numbers. We act as a facilitator between users and telecom providers and follow TRAI and DOT guidelines for SIM activation. Any disputes about services or tariffs must be resolved directly with the telecom service provider.
3. ELIGIBILITY
3.1. Users must be legally capable of entering into contracts under the Indian Contract Act, 1872. Minors under 18 years may use the Website only through a legal guardian. CatchyDigits reserves the right to terminate accounts of minors using the Website without guardian supervision.
4. USER ACCOUNTS
4.1. To use our services, you must create an account by providing accurate information and maintaining its confidentiality.
4.2. Users are responsible for all activity under their account. If unauthorized access occurs, notify CatchyDigits immediately.
4.3. CatchyDigits may suspend or terminate accounts with inaccurate or incomplete information.
5. COMMUNICATIONS
5.1. By using the Website, you agree to receive communications electronically via email or other channels regarding your transactions and updates.
6. USAGE GUIDELINES
6.1. Users are responsible for providing the necessary equipment and internet access. The Website may only be used for lawful purposes.
6.2. Users shall not engage in activities that harm the Website’s performance or security. Unauthorized access attempts, transmission of viruses, or harmful files are strictly prohibited.
7. PRICING
7.1. All prices are listed in Indian Rupees (INR) and include applicable taxes and delivery charges unless stated otherwise.
7.2. Pricing may vary based on the type of mobile number (e.g., prepaid, postpaid, fancy). CatchyDigits does not guarantee the lowest prices.
7.3. Prices are subject to change without prior notice.
8. PAYMENT AND CANCELLATION
8.1. Payments are processed through Cash on Delivery (COD) within Mumbai and other digital payment gateways. A receipt will be provided electronically or in hard copy.
8.2. CatchyDigits reserves the right to cancel or modify orders before SIM activation and will issue refunds through the original payment method.
8.3. Any disputes related to SIM activation must be resolved with the telecom provider. CatchyDigits only facilitates the purchase of telecom services and products.
9. USER OBLIGATIONS
9.1. Users are granted a limited, non-transferable right to access the Website.
9.2. Users must not engage in unlawful activities, violate the rights of others, or misuse the Website.
9.3. Activities such as impersonation, spreading malware, hacking, unauthorized access, or spamming are prohibited.
10. INTELLECTUAL PROPERTY
10.1. The content, design, and materials on the Website are protected by copyright, trademarks, and intellectual property laws.
10.2. Users may download or print content for personal use but must acknowledge CatchyDigits.in as the source.
10.3. Unauthorized commercial use or reproduction of Website content is prohibited.
11. DOCUMENTATION AND ACTIVATION
11.1. SIM cards will only be activated upon submission of mandatory documents, including:
- 1 Passport-sized photograph
- Proof of Identity (POI)
- Proof of Address (POA)
11.2. Users must ensure that all submitted documents are valid, self-attested, and correctly filled. Delays or rejections due to incomplete or incorrect documents are not the responsibility of CatchyDigits.
11.3. Once documents are submitted to the telecom provider, CatchyDigits cannot be held liable for further processing delays or rejections.
12. DELIVERY
12.1. Orders are delivered within 36 hours to serviceable locations, subject to unforeseen delays.
12.2. Users must be present at the delivery address to receive their order, or the order may be canceled.
12.3. After delivery, the user must provide the required documents for SIM activation.
13. LIMITATION OF LIABILITY
13.1. CatchyDigits is not liable for issues with third-party applications (e.g., WhatsApp or Telegram). Users must contact the respective app’s support for assistance.
13.2. CatchyDigits will not provide refunds or compensation for spam calls or messages received on purchased numbers. Users should contact their network operator to resolve such issues.
14. DISPUTE RESOLUTION AND JURISDICTION
14.1. Any disputes will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
14.2. The courts of Thane, Maharashtra will have exclusive jurisdiction over any legal matters.
